All contractors who do not have a direct contract with the property owner are required to send this notice. It must be sent within 20 days of first providing labor, services, equipment, or materials to the project. The notice must be delivered to the Owner, General Contractor, and Lender or Surety.
If more than 20 days have passed, you may still send the notice. However, it will only protect your lien rights for work performed or materials supplied after the notice is served, as well as for the 20 days prior to the date of service.
This notice is essential for protecting your Mechanic’s Lien and Stop Notice rights in case of nonpayment. It applies to subcontractors, material suppliers, engineers, and architects who are not under direct contract with the owner.
